NANNY STATE BILL OF THE WEEK: SB19-012

Current Colorado law prohibits the use of a phone while driving for people under 18 years old.

SB19-012 would extend that prohibition to everyone and established penalties for a violation.

  • $300 and 4 points for a first violation.
  • $500 and 6 points for a second violation.
  • $750 and 8 points for a third or subsequent violation.

Why? Because the government has to protect you from yourself, of course.

The law requires you to use a hands-free device, and creates exceptions to the law like certain emergencies.

Let’s be honest, a majority of drivers already drive using one hand most of the time, and many people don’t have vehicles that have bluetooth capabilities.

So when you’re driving down the interstate in your 2002 Ford F-150 and your wife calls you when you’re not expecting it, are you not going to answer cause you might be breaking the law?

Of course not.

People, particularly lawmakers, continue to push for the criminalization of victimless acts.

What is the harm of talking on the phone for 2 minutes? Is everyone else on the road more at risk because you’re having a conversation – which you would if you were on Bluetooth anyway? Or if your hand is on a phone, rather than relaxing out the window?

If there’s an accident, someone is at fault, and when that happens, people can be punished if they are at fault.

People cry about the government staying out of our bedrooms, and houses. What about our vehicles?

  1. This is one law that I agree with. What did everyone do before you had a cell phone? What is the need for instant communication? If you are worried, pull of on the shoulder or get of at the nearest exit. This law isn’t protecting you from yourself it is protecting all the people that you might harm.
